The Kenya Plant Health Inspectorate Service Act No. 54 of 2012 prescribes under Schedule 1 The Plant Protection Act Cap 324 and The Seeds and Plant Varieties Act Cap 326 as some of the laws to be implemented by the Service. The Plant Protection Act Cap 324 is currently under review to strengthen the regulatory framework for prevention of introduction and management of plant pests and disease in Kenya.
Regulations under Cap 324 have also been developed to provide for the better carrying into effect the provisions of the law. The Seeds and Plant Varieties (Plant Breeder’s Rights Regulations 2022 and Forest Tree Seeds Regulations 2021) under Cap 326 are also currently under review/development to promote an effective system of plant variety protection, with the aim of encouraging the development of new varieties of plants, for the benefit of society and the governance of Forest tree seeds respectively.
